Release of Liability. You have purchased a product or program that includes a combination of physical activity, machinery, equipment, helicopter or airplane rides that is either on or off the premises of Cardone Enterprises or its chosen venue,  and you agree to assume all liability and shall release, defend, indemnify, and hold Elena Cardone, Grant Cardone, Cardone Enterprises, its affiliates, and their respective employees, officers, directors, and agents (all as indemnified parties) free and harmless from and against all losses in connection herewith in respect of injury to or death howsoever arising and whether or not caused by the negligence (whether sole, joint, or concurrent, or active or passive) of the indemnified parties, except to the extent such loss is caused by the gross negligence or willful misconduct of an indemnified party. You understand that this experience requires physical exertion that may be strenuous and may cause physical injury, and you are fully aware of the risks and hazards involved. It is your responsibility to modify any movements to fit your limitations and level of conditioning.

Scope of Relationship. Both you and we agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of this Agreement.

Please be advised, that by submitting your signature, you understand and agree to be videotaped, audio recorded and photographed during the experience and that all photos and videos will become the property of CTTI,  GRANT CARDONE™,  and all affiliated companies and will not be returned. I hereby hold harmless, release, and forever discharge GRANT CARDONE™,  and all affiliated companies from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization. If my testimony is cut or not used, I agree that this was at the artistic discretion of CTTI, GRANT CARDONE™,  and all affiliated companies and or its affiliates and that I will not take legal action. I also agree that any claims will be Arbitrated through the American Arbitration Association and that jurisdiction for any all claims is Miami, Florida .I hereby RELEASE, WAIVE and FOREVER DISCHARGE any and all claims arising out of, or in connection with, such use by CTTI, GRANT CARDONE™,  and all affiliated companies, including without limitation any and all claims for libel or invasion or privacy. I have read the above Release and am fully familiar with the contents thereof. This Release contains the entire agreement between the parties hereto and supersedes any other Agreement that may exist.

Arbitration.  (a) Any dispute, question or difference arising between the parties to this Agreement in connection with this Agreement or otherwise in regard to the relationship of the parties hereto by virtue of the terms in this Agreement, including the construction and scope of this Agreement, that cannot be amicably resolved between them, shall be finally settled in accordance with Commercial Arbitration rules and regulations of the American Arbitration Association (“Association”) then in effect by one or more arbitrators mutually selected by the parties from the commercial panel of the Association.  The arbitrator(s) to be appointed shall be English speaking persons.  The arbitrator(s) shall have the power to extend time for pronouncing the award with the consent of the parties.  Judgment upon an arbitration may be entered in any court having competent jurisdiction thereof, and shall be binding, final and non-appealable.  The arbitrator(s) shall have the power to award any and all remedies and relief whatsoever that is deemed appropriate under the circumstances, including, but not limited to, money damages and injunctive relief.   (b)This arbitration provision shall be deemed to be self-executing and shall remain in full force and effect after the expiration or termination of this Agreement.  In the event any party fails to appear at any arbitration proceeding, an award may be entered against such party by default or otherwise notwithstanding said failure to appear.  The parties hereby consent to arbitration to be held within the City of Miami, State of Florida, and irrevocably agree that all actions or proceedings relating to this Agreement shall take place in the City of Miami and waive any objections that they may have based on improper venue or forum non conveniens. The arbitrator(s)’ fees in connection with any such arbitration proceeding shall be shared equally among the parties hereto.

Jurisdiction. Client agrees that this Agreement is governed by and shall be construed in accordance with the laws of the State of Florida, without reference to conflicts of laws principles. Each of the Parties irrevocably submits to the exclusive jurisdiction of the state and federal courts situated in the State of Florida for purposes of any suit, action or other proceeding arising out of this Agreement or any transaction contemplated hereby and agrees not to commence any action, suit or proceeding relating hereto except in such courts.  Client also agrees that the parties shall attempt to mediate any disagreement before filing any lawsuit. 

Confidentiality.  All confidential information, including, but not limited to, any business, technical, financial, and customer information, disclosed by one party to the other during negotiation or the effective term of this Agreement which is marked “Confidential,” will remain the sole property of the disclosing party, and each party will keep in confidence and not use or disclose such proprietary information of the other party without express written permission of the disclosing party.

COVID-19 WAIVER

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies have suggested certain guidelines to prevent the transmission and spread of COVID-19, which Grant Cardone™ and his affiliated companies are following.  As global health concerns continue to develop, our team is working diligently behind the scenes, coordinating with federal, state and local officials in monitoring and assessing overall impact, while actively ensuring our live events are compliant and safe. 

We will require this screening waiver be signed by everyone as a condition of  attending the event. 

We discourage any attendees that have been exposed to anyone with COVID-19 to not attend any live events. Also, any attendee who has had a runny or stuffy nose, fever, cough, sore throat, symptoms of diarrhea, and symptoms of vomiting within the previous two weeks of the event should not attend the event.  

For the safety and health of all attendees, we will conduct thermal scanning upon entry to the event venue and everyone will be required to wear a face covering. This is a private event, and we reserve the right to refuse entry, or eject any one from the event, for failure to wear a face covering or for not following any of these safety guidelines. We will also enforce social distancing and we ask that everyone refrain from shaking hands and to please sanitize hands frequently.  

Attestation

I hereby release, covenant not to sue, discharge, and hold harmless Grant Cardone™ and his affiliated companies , its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Grant Cardone™ and his affiliated companies, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after attendance at the live event. 

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending this live event. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any personal injury, disability, illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my attendance at the live event.

By signing this Waiver, I warrant that I have not been exposed to anyone with COVID-19 in the last 14 days, that I have not traveled to or from a country that is currently a “hot spot” for COVID-19, that I have not had any flu-like or COVID-19 symptoms, such as, but not limited to, a runny or stuffy nose, fever, cough, sore throat, diarrhea or vomiting.  I also acknowledge that I have willingly submitted to temperature screening upon entering the live event venue.
